The Residential Tenancy Act (RTA) stipulates that all tenants must move by 1:00PM on the lat day of the agreement, unless the agreement states differently.  You are expected to return the rental unit to the landlord in the same condition it was in the day you occupied the unit.  Normal wear and tear are excepted from this rule.  Before you move out you should:

 

Steam clean or shampoo the carpets if the period of the lease was over one year, you were a smoker, or you had pets.

Clean all windows and window coverings (if applicable), especially if you smoked.

Repair any damage to walls from nail holes or other wall hangings.

Clean all appliances, hard surfaces, and walls

Clean fireplace (if applicable)

Return all keys (even those you had cut yourself)

 

   It is a good idea to schedule a walk through of the unit, with a copy of the condition inspection report that you filled out at the beginning of the tenancy agreement.  (You did fill one out, didn't you?)   This will help you and the landlord determine what, if any, damage has occurred to the unit during your tenancy.

     If the landlord has to perform any duties in order to clean or repair the unit to return it to a rentable condition, he can charge you for the cost and deduct this amount from your damage deposit.  The amount of damage (for example: what is normal wear and tear and what is damage caused by the tenant) is subjective and can be negotiated.  If an agreement cannot be reached between the landlord and the tenant as to the amount of damage, then the RTA has a provision for arbitration.  There is a cost associated with arbitration, so it is usually best to come to an agreement on this matter privately.

 

     Remember to leave a forwarding address with the landlord so he can send your security deposit to you.  Failure to do so may cause you to forfeit any claim you may have to a refund of the security deposit. You are also entitled to any interest on your security deposit, if any is allowed by the RTA.
